Khoản 6, Điều 4, Nghị định 58/2026/NĐ-CP (có hiệu lực từ ngày 15.3.2026) quy định sửa đổi, bổ sung Điều 9, Nghị định 154/2024/NĐ-CP quy định chi tiết một số điều và biện pháp thi hành Luật Cư trú như sau:
Điều 9. Hồ sơ, thủ tục xóa đăng ký thường trú
1. Trong thời hạn 01 ngày kể từ ngày nhận được quyết định hủy bỏ đăng ký thường trú của thủ trưởng cấp trên trực tiếp hoặc ngay sau khi ra quyết định hủy bỏ đăng ký thường trú đối với công dân, cơ quan đăng ký cư trú thực hiện việc xóa đăng ký thường trú đối với công dân và cập nhật việc xóa đăng ký thường trú vào Cơ sở dữ liệu về cư trú, Cơ sở dữ liệu quốc gia về dân cư.
2. Trong thời hạn 01 ngày làm việc, kể từ ngày Cơ sở dữ liệu quốc gia về dân cư, cơ quan đăng ký cư trú tiếp nhận thông tin phản ánh về người thuộc trường hợp bị xóa đăng ký thường trú quy định tại điểm a, đ khoản 1 Điều 24 Luật Cư trú, cơ quan đăng ký cư trú có trách nhiệm kiểm tra, xác minh, thực hiện xóa đăng ký thường trú đối với công dân và cập nhật việc xóa đăng ký thường trú vào Cơ sở dữ liệu về cư trú, Cơ sở dữ liệu quốc gia về dân cư.
3. Trong thời hạn 07 ngày, kể từ ngày hộ gia đình có người thuộc diện xóa đăng ký thường trú theo quy định tại điểm b, d, e, g, h, i khoản 1 Điều 24 Luật Cư trú thì người thuộc diện xóa đăng ký thường trú hoặc đại diện hộ gia đình hoặc người đại diện theo pháp luật có trách nhiệm thực hiện thủ tục xóa đăng ký thường trú.
a) Hồ sơ xóa đăng ký thường trú gồm: Tờ khai thay đổi thông tin cư trú và giấy tờ, tài liệu chứng minh thuộc một trong các trường hợp xóa đăng ký thường trú;
b) Người thực hiện thủ tục nộp 01 hồ sơ trực tuyến qua Cổng dịch vụ công quốc gia hoặc ứng dụng định danh quốc gia (VNelD) đến cơ quan đăng ký cư trú.
4. Trường hợp người bị đề nghị xóa đăng ký thường trú chưa có thông tin trong Cơ sở dữ liệu quốc gia về dân cư hoặc thông tin về người đó trong Cơ sở dữ liệu quốc gia về dân cư không đầy đủ, chính xác thì cơ quan đăng ký cư trú có trách nhiệm thu thập, cập nhật vào Cơ sở dữ liệu quốc gia về dân cư.
5. Trong thời hạn 05 ngày làm việc, kể từ ngày nhận được hồ sơ hợp lệ thì cơ quan đăng ký cư trú thực hiện xóa đăng ký thường trú đối với công dân và cập nhật việc xóa đăng ký thường trú vào Cơ sở dữ liệu về cư trú, Cơ sở dữ liệu quốc gia về dân cư.
6. Trường hợp người thuộc diện xóa đăng ký thường trú theo quy định tại điểm b, d, e, g, h, i khoản 1 Điều 24 Luật Cư trú mà hộ gia đình chỉ có 01 người hoặc đại diện hộ gia đình hoặc người đại diện theo pháp luật không thực hiện thủ tục xóa đăng ký thường trú thì cơ quan đăng ký cư trú có trách nhiệm kiểm tra, xác minh, lập biên bản về việc công dân, đại diện hộ gia đình không thực hiện thủ tục xóa đăng ký thường trú và thực hiện xóa đăng ký thường trú đối với công dân.
7. Cơ quan, đơn vị quản lý người học tập, công tác, làm việc trong lực lượng vũ trang nhân dân có văn bản đề nghị cơ quan đăng ký cư trú trên địa bàn đóng quân xóa đăng ký thường trú đối với người thuộc đơn vị mình quản lý. Văn bản đề nghị cần nêu rõ họ, chữ đệm và tên khai sinh; ngày, tháng, năm sinh; số định danh cá nhân của người thuộc trường hợp xóa đăng ký thường trú; lý do đề nghị xóa đăng ký thường trú.
8. Sau khi thực hiện việc xóa đăng ký thường trú, cơ quan đăng ký cư trú thông báo bằng văn bản giấy hoặc bản điện tử hoặc hình thức điện tử khác cho người bị xóa đăng ký thường trú hoặc đại diện hộ gia đình.
Như vậy, từ ngày 15.3.2026, hồ sơ, thủ tục xóa đăng ký thường trú thực hiện theo quy định nêu trên.

Clause 6, Article 4, Decree 58/2026/ND-CP (effective from March 15, 2026) amends and supplements Article 9, Decree 154/2024/ND-CP detailing some articles and measures for implementing the Law on Residence as follows:
Article 9. Dossier and procedures for canceling permanent residence registration
1. Within 01 day from the date of receiving the decision to cancel permanent residence registration from the direct superior or immediately after issuing the decision to cancel permanent residence registration for a citizen, the residence registration agency shall carry out the cancellation of permanent residence registration for the citizen and update the cancellation of permanent residence registration in the Residence Database and the National Population Database.
2. Within one working day from the date the National Population Database and the residence registration agency receive information regarding individuals subject to permanent residence registration cancellation as stipulated in points a and d, Clause 1, Article 24 of the Law on Residence, the residence registration agency is responsible for checking, verifying, and carrying out the permanent residence cancellation for the citizen and updating the permanent residence cancellation in the Residence Database and the National Population Database.
3. Within seven days from the date a household has a person subject to permanent residence registration cancellation as stipulated in points b, d, e, g, h, and i, Clause 1, Article 24 of the Law on Residence, the person subject to permanent residence registration cancellation, or the household representative, or the legal representative is responsible for carrying out the permanent residence cancellation procedure.
a) The application for permanent residence registration cancellation includes: a declaration form for changes in residence information and documents proving eligibility for permanent residence registration cancellation;
b) The applicant submits one application online through the National Public Service Portal or the National Identification Application (VNelD) to the residence registration authority.
4. If the person whose permanent residence registration is requested to be cancelled does not have information in the National Population Database or the information about that person in the National Population Database is incomplete or inaccurate, the residence registration authority is responsible for collecting and updating the information in the National Population Database.
5. Within 05 working days from the date of receiving a valid application, the residence registration authority shall cancel the permanent residence registration for the citizen and update the cancellation in the Residence Database and the National Population Database.
6. In cases where a person is subject to permanent residence deregistration as stipulated in points b, d, e, g, h, and i of Clause 1, Article 24 of the Law on Residence, and the household consists of only one person, or the household representative or legal representative fails to complete the permanent residence deregistration procedure, the residence registration agency is responsible for checking, verifying, and recording the failure of the citizen or household representative to complete the permanent residence deregistration procedure and proceeding with the deregistration of the citizen.
7. Agencies and units managing individuals studying, working, or employed in the People's Armed Forces shall submit a written request to the residence registration agency in their area of operation to deregistration the permanent residence of the person under their management. The request must clearly state the full name (first name, middle name, and given name); date of birth; personal identification number of the person subject to permanent residence deregistration; and the reason for the request.
8. After the permanent residence registration is cancelled, the residence registration authority shall notify the person whose permanent residence registration has been cancelled or their household representative in writing, electronically, or by other electronic means.
Therefore, from March 15, 2026, the procedures and documents for canceling permanent residence registration shall be carried out according to the regulations mentioned above.
