Bỏ xe vi phạm giao thông sẽ không được đăng ký xe máy mới
Hiện nay, không ít người có tâm lý trốn tránh nộp phạt vi phạm giao thông và bỏ xe máy bị thu giữ. Tuy nhiên, nếu bỏ xe, người dân sẽ không được đăng ký xe mới.
Bỏ xe máy cũ sẽ không được đăng ký xe mới
Theo thông tin từ Cục Cảnh sát giao thông, dịp Tết Nguyên đán, lực lượng chức năng thu giữ nhiều phương tiện vi phạm.
Tính riêng ngày 21.2 (mùng 5 Tết), cảnh sát giao thông, công an các đơn vị, địa phương đã đồng loạt ra quân xử lý chuyên đề nồng độ cồn trên các tuyến giao thông trong một khung giờ nhất định theo mệnh lệnh chỉ đạo của Cục trưởng Cục Cảnh sát giao thông.
Lực lượng cảnh sát giao thông Công an 34/34 địa phương tiếp tục đồng loạt kiểm soát nồng độ cồn đối với người điều khiển phương tiện tham gia giao thông từ 10 giờ đến 14 giờ ngày 21.2.2026 (mùng 5 Tết Bính Ngọ).
Kết quả, lực lượng Cảnh sát giao thông đã kiểm soát 32.299 lượt phương tiện (1.397 xe khách, 1.251 xe tải, 8.250 xe con, 20.664 xe máy, 737 xe thô sơ và phương tiện khác); phát hiện và lập biên bản xử lý 724 trường hợp vi phạm nồng độ cồn (10 xe con, 691 xe máy, 6 xe chuyên dùng, 17 xe thô sơ và phương tiện khác).
Theo quy định, các trường hợp vi phạm nồng độ cồn sẽ bị tạm giữ phương tiện.
Trên thực tế, không ít người dân có tâm lý bỏ luôn xe vi phạm, nhất là xe máy giá trị thấp để trốn tránh nộp phạt. Tuy nhiên, việc bỏ xe sẽ đối diện với nhiều rắc rối pháp lý.
Luật sư Nguyễn Thu Trang, Phó Giám đốc Công ty trách nhiệm hữu hạn Luật Heva cho biết, nếu người vi phạm nồng độ cồn bỏ xe, không chấp hành nộp phạt thì sẽ không được đăng ký xe mới.
Thông tư 24/2023/TT-BCA quy định về cấp, thu hồi đăng ký, biển số xe cơ giới, được sửa đổi, bổ sung tại Thông tư số 51/2025/TT-BCA của Bộ Công an nêu rõ:
Tổ chức, cá nhân vi phạm trật tự, an toàn giao thông mà không chấp hành quyết định xử phạt vi phạm hành chính trong lĩnh vực giao thông thì chưa được giải quyết đăng ký xe; sau khi chấp hành xong quyết định xử phạt vi phạm hành chính trong lĩnh vực giao thông thì được đăng ký xe theo quy định của Thông tư này.
Do đó, khi bị xử phạt lỗi vi phạm nồng độ cồn mà người điều khiển phương tiện chưa nộp phạt thì sẽ không được đăng ký xe mới.
Mức xử phạt nồng độ cồn và trừ điểm giấy phép lái xe đối với người điều khiển xe máy
Theo Điều 7 Nghị định 168/2024/NĐ-CP, mức xử phạt, trừ điểm giấy phép lái xe của người điều khiển xe mô tô, xe gắn máy và các loại xe tương tự quy định như sau:
Phạt tiền từ 2.000.000 đồng đến 3.000.000 đồng đối với người điều khiển xe trên đường mà trong máu hoặc hơi thở có nồng độ cồn nhưng chưa vượt quá 50 miligam/100 mililít máu hoặc chưa vượt quá 0,25 miligam/1 lít khí thở; trừ 4 điểm giấy phép lái xe.
Phạt tiền từ 6.000.000 đồng đến 8.000.000 đồng đối với người điều khiển xe trên đường mà trong máu hoặc hơi thở có nồng độ cồn vượt quá 50 miligam đến 80 miligam/100 mililít máu hoặc vượt quá 0,25 miligam đến 0,4 miligam/1 lít khí thở; trừ 10 điểm giấy phép lái xe.
Phạt tiền từ 8.000.000 đồng đến 10.000.000 đồng đối với người điều khiển xe trên đường mà trong máu hoặc hơi thở có nồng độ cồn vượt quá 80 miligam/100 mililít máu hoặc vượt quá 0,4 miligam/1 lít khí thở; tước quyền sử dụng giấy phép lái xe từ 22 đến 24 tháng.
Phạt tiền từ 6.000.000 đồng đến 8.000.000 đồng đối với người điều khiển xe ô tô trên đường mà trong máu hoặc hơi thở có nồng độ cồn nhưng chưa vượt quá 50 miligam/100 mililít máu hoặc chưa vượt quá 0,25 miligam/1 lít khí thở; trừ 4 điểm giấy phép lái xe.
Mức xử phạt nồng độ cồn và trừ điểm giấy phép lái xe đối với người điều khiển xe ôtô
Căn cứ Điều 6 Nghị định 168/2024/NĐ-CP, mức xử phạt, trừ điểm giấy phép lái xe của người điều khiển xe ôtô và các loại xe tương tự quy định như sau:
Phạt tiền từ 6.000.000 đồng đến 8.000.000 đồng đối với người điều khiển xe trên đường mà trong máu hoặc hơi thở có nồng độ cồn nhưng chưa vượt quá 50 miligam/100 mililít máu hoặc chưa vượt quá 0,25 miligam/1 lít khí thở; trừ 4 điểm giấy phép lái xe.
Phạt tiền từ 18.000.000 đồng đến 20.000.000 đồng đối với người điều khiển xe trên đường mà trong máu hoặc hơi thở có nồng độ cồn vượt quá 50 miligam đến 80 miligam/100 mililít máu hoặc vượt quá 0,25 miligam đến 0,4 miligam/1 lít khí thở; trừ 10 điểm giấy phép lái xe.
Phạt tiền từ 30.000.000 đồng đến 40.000.000 đồng đối với người điều khiển xe trên đường mà trong máu hoặc hơi thở có nồng độ cồn vượt quá 80 miligam/100 mililít máu hoặc vượt quá 0,4 miligam/1 lít khí thở; tước quyền sử dụng giấy phép lái xe từ 22 tháng đến 24 tháng.

As a result, traffic police inspected 32,299 vehicles (1,397 passenger buses, 1,251 trucks, 8,250 cars, 20,664 motorcycles, 737 non-motorized vehicles and other vehicles); detecting and issuing citations for 724 cases of drunk driving (10 cars, 691 motorcycles, 6 specialized vehicles, 17 non-motorized vehicles and other vehicles).
According to regulations, vehicles involved in drunk driving violations will be temporarily impounded.
In reality, many people tend to abandon their vehicles, especially low-value motorcycles, to avoid paying fines. However, abandoning the vehicle will lead to many legal complications.
Lawyer Nguyen Thu Trang, Deputy Director of Heva Law Firm, stated that if a drunk driver abandons their vehicle and refuses to pay the fine, they will not be allowed to register a new vehicle.
Circular 24/2023/TT-BCA, which regulates the issuance and revocation of vehicle registration and license plates, as amended and supplemented by Circular 51/2025/TT-BCA of the Ministry of Public Security, clearly states:
Organizations and individuals who violate traffic order and safety and fail to comply with administrative penalties in the field of traffic will not be allowed to register their vehicles; after complying with the administrative penalty decision in the field of traffic, they may register their vehicles according to the provisions of this Circular.
Therefore, if a driver is fined for drunk driving and has not yet paid the fine, they will not be allowed to register a new vehicle.
Penalties for drunk driving and license point deductions for motorcycle drivers
According to Article 7 of Decree 168/2024/ND-CP, the penalties and license point deductions for drivers of motorcycles, mopeds, and similar vehicles are as follows:
A fine of VND 2,000,000 to VND 3,000,000 will be imposed on drivers who operate a vehicle on the road with a blood alcohol concentration (BAC) or breath alcohol concentration (BAC) that does not exceed 50 milligrams/100 milliliters of blood or 0.25 milligrams/1 liter of breath; 4 points will be deducted from their driver's license.
A fine of VND 6,000,000 to VND 8,000,000 will be imposed on drivers operating vehicles on the road with a blood alcohol concentration exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath; 10 points will be deducted from the driver's license.
A fine of VND 8,000,000 to VND 10,000,000 will be imposed on drivers operating vehicles on the road with a blood alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath; the driver's license will be revoked for 22 to 24 months.
A fine of VND 6,000,000 to VND 8,000,000 will be imposed on drivers of automobiles who operate vehicles on the road with a blood alcohol concentration (BAC) or breath alcohol concentration (BAC) that does not exceed 50 milligrams/100 milliliters of blood or 0.25 milligrams/1 liter of breath; 4 points will be deducted from their driver's license.
Penalties for alcohol concentration and driver's license point deduction for automobile drivers
Based on Article 6 of Decree 168/2024/ND-CP, the penalties and driver's license point deductions for drivers of automobiles and similar vehicles are stipulated as follows:
A fine of VND 6,000,000 to VND 8,000,000 will be imposed on drivers of automobiles and similar vehicles who operate vehicles on the road with a BAC or BAC that does not exceed 50 milligrams/100 milliliters of blood or 0.25 milligrams/1 liter of breath; A penalty of 4 points will be deducted from the driver's license.
A fine of VND 18,000,000 to VND 20,000,000 will be imposed on drivers operating vehicles on the road with a blood alcohol concentration exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath; a penalty of 10 points will be deducted from the driver's license.
A fine of VND 30,000,000 to VND 40,000,000 will be imposed on drivers operating vehicles on the road with a blood alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath; the driver's license will be revoked for 22 to 24 months.
